In accordance with the provisions of Law 544/ 2001 and OG 27/ 2002, AFIR ensures the provision of information of public interest, ex officio and upon request, through specialized staff at central, regional and county level.

To request information of general public interest or to submit a petition, you can send a request to the headquarters of AFIR or to any of the headquarters of AFIR at the central and regional level (the addresses of the County Offices and Regional Centers of AFIR can be found in the CONTACT section of this web page) as follows:

The free and unrestricted access to any information of public interest constitutes one of the fundamental principles of the relations between individuals and public authorities, in accordance with the Romanian constitution and international documents ratified by the Romanian Parliament (according to Law no. 544/12.10.2001 on free access to information of public interest).

Also, any citizen has the right to address to the authorities and public institutions petitions formulated in his own name, as well as to be informed as to how to resolve them (according to the Government Ordinance no. 27/2002 on the regulation of the activity of resolution of petitions and Law no. 233/2002 for the approval of Government Ordinance no. 27/2002).

 

INFORMATION OF A GENERAL OR SPECIFIC CHARACTER can be: information on the conditions and method of accessing European funds granted through NPRD, information that respects the same form and content as the information and presentation materials certified and approved for publication by AFIR and MARD (identical rendering of a text or a compilation of texts from the Applicant's Guide, from leaflets, presentations, guidance, brochures), information regarding the confirmation and method of processing personal data, as well as the purpose of the processing and the categories of data considered (in accordance with the provisions of the Law 677 of November 21st, 2001, with subsequent amendments and additions), AFIR's contact details, the work schedule with the public or redirections to other institutions.

AFIR ensures the processing of personal data in accordance with the provisions of Law 677/2001 for the protection of individuals regarding the processing of personal data and the free movement of such data.

Thus, AFIR processes the personal data of the persons concerned (NPRD's beneficiaries and users registered on the AFIR portal) in order to send notifications, in the process of contracting the project and its monitoring, as well as ensuring publicity and promotion of the NPRD.

These data are processed with the notification and consent of the persons concerned, through the contract and by checking the specific button on the user registration page on the AFIR website.

AFIR states that the persons involved can request information related to the right to access data, intervention and opposition on data by sending an email to the address relatii.publice@afir.info or to AFIR's website address in the Type Form.

 

PETITION is the request, complaint, notification or proposal formulated in writing or by electronic mail, which a citizen or a legally constituted organization can address to central and local public authorities and institutions, decentralized public services of ministries and other central bodies, companies and national companies, commercial companies of county or local interest, as well as autonomous directions.

To submit a petition regarding certain information or to report possible irregularities, inform us in writing.

Attention! In order to be able to start the investigations and take the necessary measures, the petition must be explicit, contain concrete, verifiable information and the contact details of the person who drew up the petition! Anonymous petitions or those, in which the identification data of the petitioner are not entered, cannot be resolved and thus will not be taken into account, being automatically classified.

The deadline for responding to requests for information of a general and specific nature is 10 days from the date of registration of the request, regardless of whether the solution is favorable or unfavorable. In the event that aspects of the pettition require a more thorough investigation, the maximum resolution period can be extended by up to 30 days from the date of registration of the request. The maximum response time is conditioned by the difficulty or complexity of the request, as well as by the volume of necessary documentary work and the urgency of the request. If the time required to identify and disseminate the response to the request exceeds 10 days, AFIR will inform the petitioner of this fact within a maximum of 10 days from the date of registration of the request.

The deadline for solving petitions is 30 days from the date of registration of the petition, regardless of whether the solution is favorable or unfavorable. In the event that the issues raised by the petition require a more thorough investigation, the maximum resolution period can be extended by no more than 15 days.

 

Protection of the financial interests of the European Union in Romania

The Anti-Fraud Department (DLAF) ensures the protection of the financial interests of the European Union in Romania. The department is responsible for controlling community funds, being the national coordinator of the anti-fraud fight.

DLAF carries out operational controls on the spot, ex officio or following notifications received from the authorities with competences in the management of community financial assistance, from other public institutions, from natural or legal persons, the mass media, the European Anti-Fraud Office (OLAF ), as well as the other Member States.

According to the provisions of Law no. 78/ 2000 in order to prevent, discovery and sanction acts of corruption, the commission of crimes against the financial interests of the European Union is punishable by up to 20 years in prison and the prohibition of certain rights.
